1. Agreement to Terms

By using the Lighthouse Call service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

The Service is an automated, non-emergency daily check-in service. It is designed to provide peace of mind and is NOT a medical alert system, a substitute for emergency services (such as 911), or a professional monitoring service. You agree that you will not rely on the Service for any life-threatening situations or immediate medical needs.

3. User Responsibilities

You are responsible for providing accurate and up-to-date contact information for yourself (the "Primary Contact") and for all members of your "Care Circle." You are also responsible for ensuring the "Loved One" is aware of and consents to receiving the automated daily calls.

4. Subscriptions and Payment

The Service is billed on a subscription basis. You will be billed in advance on a recurring, periodic basis (either monthly or annually). Subscriptions will automatically renew unless canceled by you prior to the renewal date.

5. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Lighthouse Call makes no warranties, express or implied, that the service will be uninterrupted, timely, secure, or error-free. Technology-based services are subject to occasional interruptions and failures.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Lighthouse Call, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

Under no circumstances will Lighthouse Call be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or your account or the information contained therein.

To the maximum extent permitted by applicable law, Lighthouse Call assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of the Service; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Service; (iii) any interruption or cessation of transmission to or from the Service. In no event shall Lighthouse Call's aggregate liability for all claims relating to the Service exceed the total amount of fees paid by you to Lighthouse Call during the three (3) month period immediately preceding the event giving rise to the claim.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect.
